Florida: Lawmakers Take No Action on Marijuana Legalization Measure

Lawmakers have adjourned the 2014 legislative session without calling this measure for a floor vote. A Florida lawmaker introduced House Bill 1039, to legalize the possession, cultivation, and retail sale of cannabis for adults. The legislation sought to remove all criminal and civil penalties for the possession of up to two and a half ounces of marijuana and would have permited the personal cultivation of up to 6 marijuana plants by those over the age of 21. The bill would also have created a system of retail cannabis outlets, cultivation facilities, and marijuana product manufacturers.

Under present law, possession of up to 20 grams of marijuana is a criminal misdemeanor, punishable by up to one year incarceration and a $1,000 fine. Possession of more than 20 grams of marijuana is a felony punishable by 5 years incarceration and a $5,000 fine.
